Abstract

Insolvency is on the rise in the Hong Kong construction industry and it alone can stay further proceedings in arbitration. When building or civil engineering companies are wound up, the question of whether to stay an arbitration that has already begun must be considered by the court or arbitral tribunal. Gary Soo reviews some recent cases and outlines a number of procedural options available to the parties.
