This article discusses the impact of the adoption of a lower standard – ‘reasonable doubt’ – for disqualifying arbitrators following challenges for alleged lack of impartiality and/or independence in ICSID cases, and postulates that this trend may have serious implications for international arbitration in Asia, both investor/State and commercial.
