This article discusses the psychology of decision-making both by judges and arbitrators. Particular attention is paid to the existence and effect of several forms of cognitive rules of thumb, or ‘heuristics’, that may adversely affect how judicial decision-makers go about deciding cases. It is an edited version of a paper delivered at the Chartered Institute of Arbitrators’ Centenary Conference in Hong Kong on 20 March 2015.
