This article reviews a debate on the effects of commercial arbitration on the development of commercial law, with particular emphasis on whether rights of appeal should be expanded or abolished. The debate was sparked by Lord Thomas’s Bailii Lecture 2016 and culminated in the Hong Kong Academy of Law’s Symposium on Developing Commercial Law through the Courts: Rebalancing the Relationship between the Courts and Arbitration held in Hong Kong on 17 October 2016.
