This article identifies and analyses the effects of a number of challenges to international commercial and investor-State arbitration and considers how those challenges may be met. It is an edited version of a Keynote Address delivered to the HKIAC ADR in Asia Conference held in Hong Kong on 18 O ctober 2016, the theme of which was ‘Arbitration Challenged’.
