The Court of Justice has delivered important recent judgments on the legal effect of third pillar measures, and on its jurisdiction to review the validity of third pillar measures (Pupino and SEGI). While these cases make a significant contribution towards ensuring effective judicial protection for individuals within the framework of the third pillar, only the application of the first pillar rules on the Court’s jurisdiction could ensure sufficient protection for the rule of law.
