The Indian Supreme Court set aside the order of the lower court and granted leave to challenge an LCIA final award, which was concerned with the transfer of shares in an Indian company. If the foreign award required performance in India, but was seen to have disregarded or breached Indian laws and regulations, the Indian court would grant leave to challenge the award under section 34 of the Arbitration and Conciliation Act, 1996.The award was one to which the New York Convention would apply.
