Abstract

The United States has long been regarded as a jurisdiction favorable to international arbitration. However, a recent decision of the Eleventh Circuit Court of Appeals may call this into question. This article analyzes the courts decision with a view towards understanding its potential impact on international arbitration in the United States, in particular with respect to the enforceability of international arbitration clauses.
