Arbitrators are increasingly playing a proactive role during the proceedings when it comes to identifying the issues to be resolved and appropriate evidence to be provided, with a view to limiting the time and cost involved. However, costs might be reduced further if arbitrators were to indicate at an early stage their likely attitude as regards costs that might be recovered, and arbitrators should not rule out discussions with the parties at an early stage as to how they might minimize their own fees and expenses.
