The purpose of the procedure for interim relief is to guarantee the full effectiveness of the definitive future decision, in order to ensure that there is no lacuna in the legal protection provided by the Court of Justice. This article examines the recent trends in the case law of both Community courts. The three conditions for granting interim relief (a prima facie case, urgency, and the balance of interests) are examined in turn, as well as other questions of substance and procedure. The case law shows a constant tension between the principle of effective judicial protection and the limitations on the powers of the judge which derive from his/her constitutional role and the need to stay within the limits of the case and not to render meaningless the main case. One of the main transformations since the end of the 1980s is that the presentation has become more standardized and the orders generally contain more detailed reasoning. Although, the introduction of expedited procedures has reduced the need for interim proceedings in certain cases, this has had a limited quantitative effect on the number of requests for interim relief. In general, obtaining interim relief is a very difficult task for private applicants and Member States. They request a change in the constitutional status of the ECB, arguing for its “subordination to political decisions”. This article attempts to give a legal answer to this political challenge by recalling, first, the ECB’s independence and special characteristics which were constitutionally entrenched in the EC Treaty with the assent of all 27 EU Member States. Taking the academic controversy about the extent of the ECB’s independence as starting point, the article then turns to the re-cent clarifications brought by a first judgment of the ECJ which underlines the special nature of the ECB as independent specialized organization of Community law. The article finally addresses the ECB-related provisions of the Treaty establishing a Constitution for Europe, which, by clarifying both the scope of the independence of the ECB and its integration into the Union’s constitutional system, have the potential to bring further stability and legitimacy to Europe’s young central bank. In political terms the accession of Bulgaria and Romania is an important step in the unification of Europe, bringing the post war divisions of the continent to the end. However, it also raises questions of the future of the European Union and its unity. The sixth enlargement has been overshadowed by the economic and legal preparedness of the newcomers. The Accession Treaty makes this wave of enlargement possible; the question remains if it will be sufficient to secure smooth integration of the two least developed and poorest members of the European Union. This article provides an overview of the key provisions of the Accession Treaty. It starts with the analysis of the structure and institutional provisions of the Treaty. This is followed by parts devoted to safeguard clauses and transitional periods. Finally, the legal implications for the EU’s external commitments are taken on board. A stimulation of stand alone actions concerning hard-core infringements is however considered unrealistic; only follow-on actions, which have a limited enforcement value, can be encouraged by legislative measures. In contrast, damages actions concerning grey-area offences can and should be facilitated. These infringements tend to be exclusionary in nature so that the private interest in pursuing a case will often outweigh the public interest. The focus on damages actions is however too narrow. Relevant EC legislation should also establish and define the core elements of injunctive relief. For both damages and injunctive relief, the main hurdle is the legal (and economic) complexity of these cases and the resultant difficulty in proving the illegality of the conduct. This is where legislative action could be useful. While this complexity cannot be changed as such, it is possible to somewhat reduce the risk connected with unpredictability. Legislative action should therefore also deal with the other elements of these remedies, in particular causation, contributory negligence, protective scope and the issue of passing on and indirect purchasers’ claims. The tenor of the scholarly debate has been on weighing the conflicting aims of protecting individual rights versus the effectiveness of the fight against international terrorism. These cases, however, also raise questions regarding the formulation and distribution of competences and responsibilities in the evolving architecture of European governance. It is argued here that two fundamentally different models could be used to conceptualize the relationship between the UN, the EU and the nation states with regard to judicial control of UN sanction measures: First, one could use the model of the (in principle) closed entity, that applies its own fundamental rights standards to the “intruding” law of a different entity and grants the power to invalidate its norms only to its own institutions. Second, one could conceive of this relationship also as an emerging network of actors in mutual cooperation, in which no recourse to the concept of closedness is made and in which actions are measured on the principles and standards of the legal order of the acting institution. The article discusses the implications of a shift from the first to the second model suggested by the CFI in “Yusuf” and “Kadi” and by AG Mengozzi in “Gestorias Pro Amnistía”. (2007) 44 Common Market Law Review, Issue 3, pp. 601–627 | | This article inquires how the EC courts deal with judgments of other international courts and tribunals, such as the European Court of Human Rights, WTO tribunals, and panels set up by the EC’s proliferating number of bilateral agreements. Having reviewed the case law to date, the essay focuses on one question in particular: should the EC courts consider themselves bound by rulings of other international tribunals? Although the ECJ recognized in the early 1990s that it might be so bound, to date it has never accepted this in actual case. The article submits that, in the absence of a specific instruction in a particular international agreement, there are strong reasons for the EC courts not to bind themselves a priori to rulings of other international tribunals. The EC Courts should normally follow the rulings of the international tribunal, but should keep the power to deviate from another international ruling in narrowly defined circumstances. Reference is made to the practice of national courts. Allowing the EC courts to perform such limited checks and balances should not weaken the Community’s credibility as a reliable negotiating partner. The Petersberg Tasks provide the only specific catalogue of military activities of the EU. Therefore, they offer important insight as to the legal scope of the European Security and Defence Policy. The article argues that the various mission types listed in the Petersberg Tasks have a fairly wide scope. In this context, it is the last mission type – “tasks of combat forces in crisis management, including peacemaking” – which raises the most difficulties. It is suggested in this paper that the term “crisis management” comprises military interventions in any conflicts that constitute a threat to the peace or a breach of the peace as long as they are outside the scope of the mutual defence clauses of NATO and the WEU. Crisis management interventions must be of a containing nature but they may include the repulse of aggression and the restoration of the integrity of the international legal order. The term “peacemaking” describes a specific aspect of crisis management: the forcible pacification of a conflict between third parties (“triangular peace enforcement”). The modifications introduced by the Constitutional Treaty are of limited importance. However, to a certain extent they mark a conceptual step from reactive emergency measures to a more proactive, constant and holistic policy. It starts by examining the jurisprudence on restrictions internal to a Member State, i.e. those imposed on transactions which do not involve traders or goods in or from other Member States. The concept of a customs union is also looked at here. The article then reflects on whether the provisions of Article 28 et seq. apply to the legal relations of individuals and companies inter se. It explores the relationship between the legal regime on free movement of goods on the one hand and those relating to persons, services, and capital on the other. There follows a discussion of the continuing development in the Court’s case law which started with Keck, drawing also on the Opinions of several Advocates General up to the most recent cases Commission v. Italy (Moped trailers) and Mickelsson. Moving from imports to exports, the authors analyse the judgments on Article 29 EC and call for clarifications in the Court’s approach. Following this, the article contemplates the cases on justifications for restrictions on the free movement of goods, encompassing the concept of “mandatory requirements”, the principle of proportionality, public health, public policy and fundamental rights as well as intellectual property. The authors conclude by commending the broad stability in the Court’s case law on these aspects of the common market, while highlighting their concerns about some specific developments. The basic requirement is the violation of an EC law provision intending to protect private parties, e.g. under the competition or free movement rules. Remedies for compensation must be found under national law, but this must obey the principles of effectiveness and equivalence, which may be summarized as the principle of “adequate protection”. The existing national remedies may need to be reshaped and “upgraded” if they do not meet EC standards. This will lead to a “hybridization of remedies” with regard to the basic requirements of a “sufficiently serious breach”, causation, amount of compensation, and adequate procedures. Even if EC law must respect the diversity of Member State laws, it should still develop adequate, effective and equivalent common standards on compensation of EU citizens if their rights protected under Community law have been illegally violated by private parties. The “primacy model” argues that supremacy is capable of producing independent “exclusionary effects” within the national legal orders, where a provision of domestic law is incompatible with Community law; direct effect is only relevant if “substitutionary effects” are at issue, where Community law is invoked as a novel source of rights or obligations not already recognized under national law. By contrast, the “trigger model” asserts that, for any provision of Community law to produce an independent effect within the national legal system (whether exclusionary or substitutionary), it must satisfy the threshold criteria for having direct effect; the principle of supremacy is thus a consequence of and dependent upon that of direct effect. The choice between these two competing models can have important practical implications, for example, in the debate about the “incidental effects” of unimplemented directives, or the potential legal effects of Third Pillar framework decisions. This article examines the conceptual underpinnings of the two models, then explores how far they are supported by the caselaw. It is argued that recent rulings such as Pfeiffer and Berlusconi undermine support for the “primacy model”; but older cases such as CIA Security and Unilever Italia remain difficult to reconcile with the “trigger model”. It is concluded that perhaps the ECJ itself has vacillated over its own understanding of the proper relationship between direct effect and supremacy, making it difficult for commentators to construct any coherent and descriptively accurate theory. It contends that the Court has taken contrasting approaches to the desirable extent of consumer protection laws, depending upon whether that protection derives from national laws which operate as derogations from the EC’s Treaty rules on the internal market or from positive legislative activity at EC level. In the former area, the Court has been unwilling to accept many such national consumer protection measures, regularly finding them not to be necessary for achieving the relevant goal or to be disproportionate to that end. In the latter area, however, the Court has consistently given an expansive interpretation to the provisions in the directives on consumer protection. The reasons behind this difference in approach are discussed and it is suggested that the Court’s support for more interventionist consumer protection measures when interpreting the scope of EC legislation sometimes fails in fact to secure the protection which the Court seems to require, or only does so at the cost of far-reaching effects upon other areas of law and practice in the relevant sectors. In conclusion, it is suggested that these differences relate to the Court’s perception of its function in interpreting and applying the primary rules of the EC Treaty, on the one hand, and in promoting the objectives of secondary law adopted under that Treaty, on the other. Two fundamentally conflicting policies are the result: free trade is the priority of primary legislation while interventionist consumer protection lies at the heart of the case law on secondary legislation. Yet the Court’s holdings merely point to a deeper-level tension in the fabric of the Community’s philosophy of market regulation. The 2006 Guidelines mark a significant change in methodology, replacing the previous ‘lump sum’ approach with one more closely tied to the undertaking’s sales in the affected markets. The 2006 Guidelines also place greater emphasis on the infringement’s duration and provide for significant fine increases for recidivism. These changes do not appear to have been motivated by judicial censure, but rather by the Commission’s own realization that the previous approach lacked consistency and transparency, and that it may not have set the right kinds of incentives to discontinue anticompetitive conduct. Only the 2006 Guidelines’ application in practice will show to what extent they achieve their aims. As a result of the change in methodology, the Commission and the courts will likely have to address a number of novel questions, such as the Commission’s discretion in determining the ‘gravity factor’, the calculation of the ‘value of sales’ affected by the infringement, the appropriateness of the last year of the infringement as the relevant reference year, and the application of the multipliers for recidivism and deterrence. More fundamentally, one could question whether (i) the 2006 Guidelines will not result in disproportionately higher fines on multi-product companies; (ii) the Guidelines set the right incentives to terminate anticompetitive conduct in some situations; (iii) the Guidelines will result in a net gain in transparency and predictability given the impact of multipliers whose application is subject to wide Commission discretion; (iv) the Commission has not bound its discretion too much in other respects; and (v) the Guidelines will not undermine other Commission policies, namely the leniency programme and its plans for a system of direct settlements. First, the article will focus on the Court’s evolving approach to the question of which national tax rules amount to a prima facie breach of the free movement rules – in particular, the Court’s shift from defining breach purely in terms of “restriction” to a discrimination-based approach. Second, it will consider developments in the Court’s attitude to justifications for prima facie breaches of Treaty free movement rules, including the nebulous concept of justification on grounds of “fiscal cohesion”. Finally, it will look at the application of the EU citizenship rules to national tax rules, and the Court’s stance on remedies where national tax rules contravene Community law. Its conclusion will be that, after a substantial period of uncertainty, the Court seems to be moving away from a pure restriction-based approach, towards a more predictable and logical system distinguishing between those restrictions of free movement which should be prohibited by the free movement rules (restrictions resulting from the discriminatory rules of one tax jurisdiction) and those restrictions which, as inevitable consequences of national tax sovereignty, should not fall within the scope of the free movement provisions at all (restrictions resulting from the interaction between two different tax jurisdictions). Obligations ensue from these framework decisions for the Member States, if necessary, to adjust their own national laws and regulations in the manner prescribed by the framework decisions. The obligation to make the necessary adjustments to national regulations is enshrined in Article 34(2)(b) TEU. When it comes to implementation, framework decisions show similarities to directives. According to Article 249(3) EC, directives are also binding as to the result to be achieved, but the choice of the form and methods of implementation is left to the Member States. In the case law of the European Court of Justice, relatively detailed rules have been developed on implementing directives. This case law defines the freedom of choice that Article 249(3) EC allows the Member States in more detail. This article centres on the question whether norms (or principles) – similar or not to the rules developed for directives – can also be identified which the Member States must observe in implementing framework decisions. It argues that national courts are independent of the European Commission and that the “supremacy” rule of the Masterfoods ruling of the Court of Justice and of Article 16 of Regulation 1/2003 ought not to be interpreted as a broad rule of precedence of public over private enforcement, which would be undesirable, but rather as an instance of the Community law principle of supremacy. For that reason, the duty imposed on national courts is in reality a negative duty of abstention, i.e. a duty “not to contradict” Commission decisions, and not a positive duty to follow entirely such decisions, since the latter do not produce a positive binding effect in a system of parallel competences. At the same time, the courts’ duty not to contradict Commission decisions extends only to the operative part of Commission decisions and not to their reasoning, which means that courts are never bound by decisions dealing with merely similar facts. Based on these premises, the article proceeds to examine four different scenarios of conflict between Commission administrative and national civil proceedings and to propose ways to resolve such conflicts. It discusses new EC legislation and other instruments adopted by the Commission of the European Communities, such as the steps taken to strengthen the Commission’s enforcement of the competition rules by the adoption of the 2006 Guidelines on the method of setting fines and the 2006 Leniency Notice. The decisional practice of the Commission is considered, in particular in the fields of cartels, fines and penalty payments, and merger control, along with recent policy initiatives, such as the potential roles of direct settlements of infringement proceedings and of private enforcement, primarily through damages actions for breaches of the competition rules. The case law of the Court of Justice and Court of First Instance during the period is surveyed. Important judgments regarding key concepts affecting the general application of the substantive provisions of Articles 81 EC and 82 EC, such as Meca-Medina, FENIN, SELEX and O2 Germany are addressed, as well as a number of rulings by the CFI on procedural issues, including certain rulings on the Austrian Banks — Club Lombard proceedings. Key case law on vertical agreements, such as GSK and Unilever Bestfoods is dealt with, as are the principal judgments concerning cartels and competitor cooperation, which principally focus on the levels of financial penalties imposed and largely confirm the Commission’s wide discretion in that area.
