(2004) 13 European Energy and Environmental Law Review, Issue 1, pp. 18–29 | | Summary: The Commission argues that the criminal law needs to be used to punish offences in breach of Community law protecting the environment. The Commission believes that only by using the criminal law can the implementation deficit effectively be remedied. In this article the author argues that this duty towards criminal enforcement seems ineffective and can potentially even be counter productive. The traditional model for implementation of European legislation is still that European environmental law will draft the norms, but that Member States remain free in their choice of the implementation techniques. European legislation and case law has reacted in various ways with effective remedies to cope with the implementation deficit. However, the idea has never been that the implementation deficit would be cured by forcing Member States to impose a specific type of sanction. This would remove the traditional freedom to choose the correct implementation instrument by the Member State and in that sense it seems non-European. Moreover, the argument that the criminal law would be necessary to guarantee a correct implementation of European environmental law seems to neglect all the instruments that European law has developed so far to force Member States towards compliance. The author opines that the Commission, at least in the directive it proposed in 2001, neglected the important question of a correct theoretical foundation for a European intervention in the area of environmental criminal law. This contribution does not aim to provide a formal institutional-legal basis for a European environmental criminal law, but rather critically addresses whether such a European environmental criminal law would anyway be necessary. The focus is mostly on the proposal for a directive presented by the Commission in 2001. If the European Court of Justice were to adopt arguments concerning the lack of competence of the Council we may assume that one day the initiative taken by the Commission in 2001 will be continued. The biggest obstacle for a greater use of renewable energies and in particular biofuels is their high production costs as compared to conventional energies. Therefore the EU has established different specific measures to promote their use and to overcome the high production costs. This article gives an insight into today's main legislative instruments, namely the Guidelines on State aid for environmental protection, the Directive on the promotion of biofuels and various taxation measures, among which is, most recently, the new Council Directive restructuring the Community framework for the taxation of energy products and electricity. It aims to present some of the main environmental issues, such as: general legal foundations, main legal instruments, procedural rules of implementation and rules of enforcement. Each issue is discussed from the viewpoint of developments within EC member states, the EC and, as a point of ``external reference'', the USA. As the features of the present day systems of Environmental law are compared, not only do we find a greater coherence but also a linkage with the concept and principles of good governance. Maybe environmental law in the legal orders concerned has reached a stage at which unification is of less importance than allowing for differences and learning from them. The process, which started in 2001 with the publication of the White Paper on a New Chemicals Policy, has now come to the legislative adoption phase. This article analyses the European Commission's proposal for a Regulation concerning the Registration, Evaluation, Authorisation and Restrictions of Chemicals (REACH), establishing a European Chemicals Agency and amending Directive 1999/45 and Regulation (EC) on Persistent Organic Pollutants, as presented in October 2003 for adoption by the European Parliament and the Council of the European Union. It analyses its individual provisions by reference to the objectives sought by the revision of the existing chemicals legislation and by reference to the general principles of Community law. However, when new eastern and central European countries join the Union, there is nothing to prevent them from abandoning these measures, as the current regime does not provide for common legal rules for nuclear safety in the EU. To this end, the European Commission has issued new proposals known as `the nuclear package', which includes a proposal for a Directive on the safety of nuclear installations, and a proposal for a Directive on spent nuclear fuel and radioactive waste management. This article discusses the legal basis for the Community's legislation on nuclear safety, the current regime and the new proposals. It focuses on energy efficiency as a criterion for the regulation of products. For this reason, the IPPC Directive will not be discussed, however it also implements energy efficiency measures as a condition of the grant of an IPPC-style permit. First attention is drawn to the link between sustainable development, integrated product policy, security of supply and protection of the environment. Then, a brief introduction is given to present market barriers which hinder the production and consumption of more energy-efficient goods. The next three sections examine the European Community's view on its energy efficiency policy and focus therefore on primary legislation, secondary legislation and policy documents. Section VII explains the potential role public procurement can play in the energy efficiency policy. In this view, the article touches upon the Concordia Bus Finland and the Wienstrom cases and makes the connection with the new legislative package aimed at the harmonisation of the existing Public Procurement Directives before some general concluding remarks. Is the proposed Package compatible with other parts of EU law, especially the basic principles of Community's environmental law and its climate change policy? This paper illustrates how the measures adopted by the Package run contradictory to the integration and prevention principle of EC environmental law, the climate change policy and infrastructure policy. The focus is the principles and the climate change policy which entails instruments of demand management and promotion of renewable energy to achieve its goals. The author suggests possible solutions to develop a sustainable and green security of energy supply policy and argues that a sustainable energy supply is a goal for the future for which action must start today. And the important issue in a sustainable energy policy is to fully incorporate the principles of EC law and the environmental protection policy. Taking into account its violation of the Community's principles, environmental law and infrastructure policy, the proposed Package must be altered. Future policies regarding security of supply must focus on generation actions that will guarantee environmentally sustainable security, especially the climate protection parameters. Demand management measures and renewable energy promotion should be regarded as the most crucial criteria and clear mandatory targets should be developed. A consistent and environmentally friendly energy policy will help the EU to achieve economical, social and ecological sustainable development. This article examines the pros and cons of arguments submitted by recognised lawyers, non-governmental organisations and industry on the one hand to show whether the agreed Directive complies with the principle of subsidiarity as set out in the Treaty establishing the European Community (ECT) but on the other that the Community institutions have failed in their duty to adequately observe the application of the subsidiarity principle. Within this conceptual framework of integration, the national transpositions of the IPPC Directive in Germany, Denmark, Spain, France, Italy, the Netherlands, Sweden and the UK are presented, and critically reviewed. On the basis of empirical implementation data and the results of legal analyses it is shown that the holistic approach of the IPPC Directive remains elusive in Europe. Therefore, the discussion concludes with some observations on regulatory credibility, efficiency, and strategy in a Union of 25 Member States.
