(2007) 13 European Public Law, Issue 2, pp. 239–261 | | The television and the mass media in general have a vital function in the creation of the democratic process, similar to that of institutions. The basic argument of this article is that television is not a simple market commodity and general competition laws cannot protect adequately the public interest of citizens in broadcasting. In Italy, in particular, the television sector has always suffered for lack of pluralism, a highly concentrated market, strong influence of political forces over public broadcasting. For these reasons the Italian experience represents an interesting case, as it allows one to observe the effects of a transition from a broadcasting framework entirely based on specific public regulation (monopoly) to a system hinged on general competition laws and technological development After looking at the evolution of broadcasting in Italy, the author will try to suggest some remedies for the Italian television sector. This article tries to design and test a comparative method to understand these evolutions and meet the demands of administrative lawyers. By resorting to a micro-analysis of mediation in the resolution of administrative law disputes, it is possible to identify and analyze a number of parallel evolutionary trends. If successful, this method could then be applied to other key areas of administrative law. In doing so, the research will uncover the dynamics and the implications of this process of deep change. Subsequently, the Commission suggested that this could lead to a new status of ‘civic citizenship’. Since this idea was floated, the Union has adopted a considerable body of legislation on immigration. This article examines these instruments, most notably the Long-Term Residents Directive, in order to decipher both the criteria for membership of civic citizenship and the rights and duties attached to this imagined status. A fragile and complex framework has been constructed for third country nationals, whilst in the same period the status of Union citizenship has been strengthened by the Court of Justice. This reveals a tension between the exclusive prerogatives of Union citizenship and the objective of improving migrant integration. Despite these efforts, States have adopted varying measures. France, for constitutional reasons, is unable to recognize officially any of its linguistic minorities. As a consequence, in practical terms, French legislation on the subject of minority language instruction at school cannot really promote, for example, the teaching of Corsican, because it must be seen to be of a voluntary nature. In other words, a minority language will be taught as long as it is not compulsory. This principle has the unfortunate corollary of threatening the existence and survival of France’s minority languages. Twenty years ago, the Adonnino Committee ventured the case for European flags and hymns and orchestras and so on. And the sentiment clearly resonated with those who were tasked with the need to shape a new European Constitution for the twenty-first century. To this end, amongst the trinkets recommended by the Convention and depicted in Article I-8 of the Constitutional Treaty was a Europe Day, to be celebrated on 7 May each year. The date was chosen because it would also serve to celebrate the original Schuman Declaration of 1950. The felt need for such a day, and such a celebration, lies at the heart of this article, which further seeks to address the wider debates which continue to oscillate around the nature of constitutions and constitutionalism in the new Europe. These debates, for obvious reasons, have become all the more intense following the various setbacks experienced as a result of the serial refusal of the Union’s citizens to ratify the proposed Constitutional Treaty. As we consider the deeper anxieties which pervade this current debate, we will also endeavour to investigate a further related issue which continues to haunt the new Europe, that of narrative and history, or its lack. And, by way of coincidence – which like so many coincidences is not entirely one at all – we shall do this in the context provided by Tim Luscombe’s recently produced play, The Schuman Plan. The future claims (‘prospective entitlements’) to unfunded public pension systems will result in severe financial strains for public finances because of the demographic developments in Germany and other industrialized nations. A closer analysis of the German (federal) constitution reveals that there are almost no provisions to handle the potential dangers from this foreseeable development. The rules on explicit public debt and the accounting requirements for the government are in this respect of little value. The law of the European Union, on the other hand, contains a somewhat better starting point as the EC Treaty requires the ‘sustainability’ of the fiscal policy. By this it offers at least a rudimentary guideline for a long term budget-policy regulation of the ‘implicit’ public debt. Stricter legal rules would, however, require an amendment of primary law of the European Union or at least a substantial redefinition of the existing definitions of the European system of Economic Accounts (ESA). One of the chief purposes of this article is to look for legal tools taking the expected financial burdens into proper account and make it more ‘visible’ for the budgetary process. It is not primarily designed to cut future pensions or to exclude ‘soft’ means from solving the underlying substantive problems. The comparative analysis of additional legal systems is left to further research. Dieser Artikel beruht auf der Annahme, dass die finanziellen Lasten einer alternden Gesellschaft als‘implizite’ Staatsschulden angesehen werden können. Anwartschaften auf Rentenzahlungen durch umlagenfinanzierte Alterssicherungssysteme können wegen des demographischen Wandels in Deutschland und anderen Industrienationen zu erheblichen Belastungen für die öffentlichen Finanzen führen. Eine genauere Prüfung der Vorgaben des Grundgesetzes für die Staatsfinanzen zeigt, dass es kaum Vorschriften gibt, welche sich mit den Gefahren aus der voraussehbaren Entwicklung befassen. Die Regeln über die Staatsverschuldung und die Rechnungslegung haben in dieser Hinsicht wenig Wert. Das Recht der Europäischen Union bietet dagegen etwas bessere Ansatzpunkte, da der EG-Vertrag die‘Nachhaltigkeit’ der Finanzpolitik verlangt. Dadurch bietet er zumindest eine rudimentäre Richtschnur für eine langfristige haushaltsmäßige Regelung der ‘impliziten’ öffentlichen Schulden. Striktere Rechtsregeln würden aber eine Änderung des primären Gemeinschaftsrechts oder zumindest eine substanzielle Umdeutung der Definitionen des Europäischen Systems der Europäischen Gesamtrechnung (ESVG) erfordern. Eines der Hauptziele dieser Untersuchung besteht darin, nach geeigneten juristischen Instrumenten zu suchen, welche die kommenden finanziellen Lasten hinreichend erfassen und im Rahmen des Finanzverfassungsrechts handhabbar machen. Sie ist nicht darauf ausgerichtet, Instrumente zur Kürzung künftiger Pensions- und Rentenzahlungen zu entwickeln oder ‘weichere’ Instrumente zur Lösung der zugrunde liegenden materiellen Probleme auszugrenzen. infoSorcha Macleod, 'Reconciling Regulatory Approaches to Corporate Social Responsibility: The European Union, OECD and United Nations Compared' (2007) 13 European Public Law, Issue 4, pp. 671–702 | | In recent years the European Union, along with other international organizations has attempted to address the globally relevant problem of Corporate Social Responsibility (CSR). In doing so, the EU has restricted itself to the voluntary mechanisms advocated by business as a means of tackling the issues. This is in direct contrast to other organizations relevant in the European context such as the OECD and the UN. This article compares these three different regulatory frameworks for CSR. It asks which of them is most effective at reconciling the inherent tension between voluntarism and the case for hard regulation as its polar opposite. To this effect, the article examines the EU, the OECD and the UN’s most recent initiatives; that is, the Global Compact and the Norms on the Responsibility of Transnational Corporations and Other Business Enterprises with regard to human rights.
