Abstract

This article surveys, on a comparative basis, the development of arbitration and ADR in Africa, the Middle East and in particular China by reference to ( inter alia ) cultural issues, the inadequacy of national courts, interpersonal relationships, the continuing influence of customary law and the growing influence of Shari'a law. It is based upon a paper given at a meeting of the European Branch of the Chartered Institute of Arbitrators at Salice d'Ulzio, Italy on 10 April 2005.
