Summary
Emergency arbitration has been introduced into the rules of many arbitral institutions over the past decade. It has different characteristics to a full arbitration, and participants need to be aware of the issues that might arise in practice, such as identifying the test to be applied by the emergency arbitrator, determining whether the emergency arbitrator has the power to grant the interim relief that is sought, and balancing the apparent urgency of the situation against the need to give the respondent sufficient opportunity to reply. This article considers those issues, following the course of an emergency arbitration from beginning to end. It draws on a number of sources including the author’s own experience of sitting as an emergency arbitrator.

L’arbitrage d’urgence a été introduit dans les règlements de nombreuses institutions arbitrales au cours de cette dernière décennie. L’arbitrage d’urgence a des caractéristiques différentes par rapport à l’arbitrage classique et les participants doivent être conscients des questions qui peuvent se poser dans la pratique, telles que l’identification du critère à appliquer par l’arbitre d’urgence, la question de savoir si l’arbitre d’urgence a le pouvoir d’ordonner la mesure provisoire qui est sollicitée, et l’équilibre à rechercher entre l’urgence apparente de la situation, d’une part, et la nécessité de donner au défendeur une occasion suffisante de répondre, d’autre part. Cet article examine ces questions en suivant le parcours d’une procédure d’arbitrage d’urgence depuis son début jusqu’à sa fin. La contribution s’appuie sur un certain nombre de sources, en ce compris l’expérience personnelle de l’auteur en tant qu’arbitre d’urgence.
