This article examines the dispute in Barclays Bank plc v Nylon Capital LLP [2011] EWCA Civ 826 at the end of which the Court of Appeal, despite the parties having settled out of court and expressed a desire for commercial privacy, decided to hand down its judgment containing a number of issues of some general significance.
