This paper seeks to survey the Dutch position on the defence known in the common law of restitution as change of position and in German enrichment law as Wegfall der Bereicherung. It argues that Dutch law fits well into the picture presented in comparative legal writings on the subject, i.e. the picture of sets of specific rules varying from country to country, yet often leading to the same outcome.
