Abstract: In the Rome IV Proposal, the European Commission suggested rules for the creation of a European Certificate of Succession (ECS). On the level of the Member States, there exist national succession certificates with very different legal character and effects. The Rome IV Proposal contains some rather short indications how the cooperation between the ECS and the national certificates shall be organized. This contribution examines the relationship of the European and the national certificates and will try to explain more clearly the model intended by the Rome IV Proposal.
Résumé : Dans la proposition Rome-IV, la commission européenne a proposé la création d’un certificat successoral européen. Sur le plan national, il existe déjà des certificats, dotés de caractères et d’effets juridiques très différents selon les Etats membres. La proposition Rome-IV contient quelques indications, plutôt brèves, sur la coordination entre le certificat successoral européen et les certificats nationaux. Cette contribution examine la relation entre le certificat successoral européen et les certificats nationaux et tente d’éclaircir le model présenté par la proposition Rome-IV.
Zusammenfassung: Der Rom-IV-Vorschlag der Europäischen Kommission enthält Regeln für die Einführung eines Europäischen Nachlasszeugnisses. Auf der Ebene der Mitgliedsstaaten finden sich nationale Erbenbescheinigungen mit sehr unterschiedlicher rechtlicher Natur und Wirkungen. Der Rom-IV-Vorschlag enthält einige eher kurz gehaltene Anweisungen, wie das Zusammenwirken zwischen dem Europäischen Nachlasszeugnis und den nationalen Erbenbescheinigungen organisiert sein soll. Dieser Beitrag untersucht die Beziehung zwischen dem Europäischen und den nationalen Zertifikaten und wird versuchen, das vom Rom-IV-Vorschlag intendierte Model etwas klarer darzustellen.
