This contribution deals with the question whether the so–called ‘reality principle’, as practised in Denmark to determine the moment to disclose information to the public, is compliant with the Market Abuse Directive. The question has been triggered by an opinion of the Danish Financial Supervisory Authority rendered in relation to the TDC takeover dispute.
