In June 2006, the Executive Committee of the International Law Association approved recommendations on res judicata and lis pendens in international arbitration which resulted from the work of its International Commercial Arbitration Committee. This article briefly describes the content of these recommendations, which are directed to arbitrators only, and summarises the reports upon which these recommendations are based. In particular, the article sheds light on the practical implications of the recommendations, as well as their limits.
