This article looks at the General Agreement on Trade in Services (GATS) footnotes as a separate sequence, in terms of both form and substance. In terms of form, the current interpretative approach towards these footnotes, which overlooks their separation from the relevant GATS Articles, is questioned. In terms of substance, interpretative patterns that may be anticipated to appear in future GATS cases are illustrated, based on the analysis of current jurisprudence.
